Photo and Marketing Release

This release is in effect and is being finalized with legal counsel; we may update the wording. If we change it, the new wording applies only to entries made after the change.

Short version: you are entering a contest with a photo. The venue running the contest, and 3rdSpace, which makes the software, may both use that photo to promote themselves. You are not paid for it. You can pull your entry out any time before entries close, and you can ask for it to come down afterwards. Some things, like something already printed, cannot be pulled back.

1. What this covers

This covers the photos you submit with your contest entry, and anything in them: you, people you entered with, costumes, pumpkins, and whatever is in the background.

It also covers the photo number, the nickname shown with your entry, the contest category, and the result, because those are usually shown with the photo.

It does not cover your name, your email address or your phone number. Those are covered by the Privacy Policy, and nothing in this release lets anyone publish them.

2. Who you are giving permission to, and what they may do

You are giving permission to two separate organizations.

a. The venue running the contest. It may use the photos to promote its own business: its social media accounts, its website, its email and text updates to customers, printed material such as posters, flyers and signs, and screens inside the venue.

b. 3rdSpace, the company that makes the software the contest runs on. It may use the photos to promote 3rdSpace: its website, its social media, screenshots and demonstrations of the product, and material it shows to other venues.

For both: this permission is non-exclusive, worldwide, and royalty free. You still own your photos. Giving this permission does not stop you using them yourself, anywhere, for anything.

Each organization is responsible only for its own use. If the venue does something with a photo that this release does not allow, that is the venue's responsibility, not 3rdSpace's, and the same the other way round.

3. What neither of them may do

Neither the venue nor 3rdSpace may:

  • sell your photo, or license it to anyone else to use in their own advertising;
  • use it to suggest you endorse a product, a person, a political position or a cause;
  • edit it in a way that is misleading or that would reasonably embarrass or harm you. Normal cropping, resizing, colour correction, adding the contest name or the venue's logo, and putting it in a layout with other entries are all fine;
  • publish your full name, your contact details, or a child's full name alongside it;
  • use a photo you have withdrawn, or one you have asked to come down, except as section 7 describes.

And one rule that applies only to children's photos. Where a photo shows someone under 18, the venue and 3rdSpace will not use it in any advertising they pay to place, such as paid social advertising or paid print placement, and will not use it to target advertising at anyone. It may appear in their own posts, their own website, their own screens and their own printed material. This is a deliberate line and it is narrower than what the law requires, because an unpaid post is a different thing from an advertisement a child appears in.

4. If you entered a child

You confirm you are that child's parent or legal guardian, and you are giving this permission on their behalf as well as your own.

The child's full name is never collected and never shown. Their entry appears under a nickname you choose.

You can withdraw or ask for removal on their behalf at any time, under sections 6 and 7, on the same terms as your own entry.

5. If you entered a group

You confirm that everyone in the photos has agreed to this release, and that where anyone in them is under 18, you are that person's parent or legal guardian.

Please read this part, because it is the honest limit of what a group entry can do. You can promise that everyone agreed. You cannot give permission on behalf of an adult who did not. If someone in your photo did not agree, they can ask for it to come down under section 7, and we will treat that request exactly as we would treat yours.

So: do not enter a photo of someone who has not actually said yes. Not because of what the law would do to you, but because it is the thing most likely to put a stranger in a position they did not choose.

6. Pulling your entry out, before entries close

Until entries close for the contest, you can withdraw completely, from your entry screen or by asking a member of staff.

When you withdraw: the entry leaves the contest, the photos stop being shown, and neither the venue nor 3rdSpace uses them for anything. The permission in section 2 ends at that moment for any new use.

7. Asking for a photo to come down, after the event

You can ask at any time afterwards, and you do not have to give a reason. Contact the venue, or contact 3rdSpace at support@3rdsp.co.

What happens:

  • Both stop using the photo for anything new, straight away.
  • Both take it down from the places they control: their own social accounts, their own websites, their own in venue screens, their own email and text templates.

What cannot be recalled, honestly:

  • anything already printed, such as posters, flyers and signs that already exist or have already been put up or handed out;
  • anything other people have already shared, saved, reposted or screenshotted. Once something is on the internet, other people have copies and neither the venue nor 3rdSpace can reach them;
  • copies already held by search engines, caches and archives, which are not ours to clear;
  • a photo that has already appeared in something that cannot be edited after publication.

We will not pretend otherwise. A takedown stops the sources. It does not unpublish the internet.

8. Deleting your data is a different request, and this is what it actually does

Asking for your photo to come down, and asking us to delete your account data, are two different things.

  • Photo down is section 7, and it is the quicker one.
  • Account data is covered by the Privacy Policy and you can ask through the deletion page, without needing to sign in.

One thing stated plainly, because the Privacy Policy states it too: part of our deletion process runs by hand and part of it is switched off pending a legal review. When you make a deletion request, we stop contacting you, we refuse any attempt to re-add you, and your record is withdrawn from the venue's list immediately. Removal of the stored copies is the part that is held, and the Privacy Policy, section 21, says what that means and how long it should take.

We would rather tell you that than write a sentence we cannot stand behind.

9. How long this lasts

The permission lasts until you withdraw it under section 6 or 7. There is no fixed end date, and you do not have to do anything to keep it from expiring, because expiring is not what it does.

Two things survive a withdrawal, and only these two: the things in section 7 that cannot be recalled, and our record that you agreed, which we keep so that we can show the permission existed for anything published while it did.

10. You are not paid for this

No payment, now or ever, for any use described in section 2. Entering is voluntary and you get nothing for the photo itself. If you win a prize, you win it from the venue for winning the contest, not for this release, and the two are not connected.

11. What you are promising us

By ticking the box you confirm that:

  • you are 18 or over;
  • the photos are yours to share, you took them or you have the right to submit them, and nobody else needs to be asked;
  • everything in section 4 or section 5 that you ticked is true;
  • the photos do not contain anything unlawful, anything that infringes someone else's rights, or anything that breaks the venue's rules for the event.

12. If something goes wrong

If somebody makes a claim against the venue or 3rdSpace because one of your promises in section 11 was not true, you are responsible for it. This does not apply to anything the venue or 3rdSpace does wrong on its own, including using a photo outside this release.

13. The rest

This release is governed by Michigan law. It does not take away any right you have under the law of your own state that cannot be given up by agreement.

This is a release, not the contest rules. The venue runs the contest, sets the categories, picks the winners and awards the prizes. 3rdSpace does not run the contest and does not award prizes. The venue's own contest rules cover all of that.

If any part of this release cannot be enforced, the rest still stands.

Questions about a photo: ask the venue first, since it is the one running the contest. About 3rdSpace's use of it: support@3rdsp.co.
